1. About These Terms

By accessing or using the Aerial Ashes website, making an enquiry, booking our services, communicating with us, or otherwise using services provided under the Aerial Ashes brand ("the Service"), operated by Aerial Ashes Ltd ("Aerial Ashes", "we", "us" or "our"), you agree to these Terms of Service ("Terms").

These Terms apply to our website, enquiries, bookings, communications and services unless separate written terms have been agreed with you.

2. About Aerial Ashes

Aerial Ashes provides specialist drone-assisted ashes-scattering ceremonies and associated services.

Our services may include ceremony planning, location research, drone operations, aerial scattering of cremated remains, photography, videography, live streaming and other associated services.

3. Enquiries and Information

Submitting an enquiry does not create a binding booking.

Information provided during the enquiry process, including potential locations, dates, flight feasibility and availability, may be provisional until we have completed any necessary operational assessments and the booking has been confirmed.

You are responsible for providing accurate information when making an enquiry or booking.

4. Bookings

A booking becomes confirmed when we have accepted the booking and any required deposit or payment has been received.

Any quotation, proposed date or proposed location may be subject to availability and operational requirements.

Additional services requested after the original booking may result in additional charges.

5. Drone Operations and Locations

Drone operations are subject to safety, weather, airspace, regulatory and operational considerations.

A proposed ceremony may therefore be affected by matters including:

  • weather conditions;
  • wind speed and visibility;
  • airspace restrictions;
  • temporary flight restrictions;
  • landowner or venue requirements;
  • regulatory requirements;
  • equipment availability or technical issues;
  • public safety considerations; and
  • the professional judgement of the drone operator.

Safety takes priority over the planned timing or location of a ceremony.

Where circumstances make the original plan unsuitable, we may propose an alternative time, date, launch point, location or other reasonable arrangement.

6. Permissions

Some locations require permission from a landowner, venue, authority or other third party.

Unless expressly agreed otherwise, a proposed location should not be treated as finally approved until any necessary checks or permissions have been completed.

We cannot guarantee that a particular landowner, venue, authority or other third party will grant permission.

7. Cremated Remains

Customers are responsible for ensuring that they have the appropriate authority to instruct us to scatter the cremated remains supplied to us.

By providing cremated remains to Aerial Ashes, you confirm that you are legally entitled or appropriately authorised to arrange their scattering.

Once ashes have been scattered, they cannot ordinarily be recovered. You should therefore ensure that all relevant family members or other interested parties have been consulted where appropriate before instructing us to proceed.

8. Weather, Postponements and Changes

Drone operations are weather dependent.

We may postpone, reschedule, alter or cancel a flight where we reasonably consider conditions unsuitable or unsafe.

Where possible, we will work with the customer to arrange a suitable alternative.

A weather-related postponement does not constitute a failure to provide the contracted service where the operation could not reasonably or safely proceed.

9. Photography, Video and Live Streaming

Where photography, videography, tribute video or live-streaming services are purchased, we will take reasonable care in providing them.

However, these services can depend upon equipment, telecommunications networks, internet connectivity, weather and third-party services.

Unless otherwise agreed, we cannot guarantee uninterrupted live-stream transmission or that every aspect of a ceremony will be captured.

10. Communications

When you provide your contact information, we may use it to communicate with you regarding:

  • your enquiry;
  • your booking;
  • potential ceremony locations;
  • our services;
  • customer support;
  • reminders and follow-ups;
  • information that may assist you in considering our services;
  • customer experiences, reviews and ceremony examples;
  • related Aerial Ashes products and services; and
  • marketing and promotional communications where permitted by law.

Depending on the contact details and permissions you provide, communications may be made by telephone, email, SMS, WhatsApp or other appropriate channels.

SMS Communications

Where you have consented to receive SMS communications from Aerial Ashes, message frequency may vary.

Standard message and data rates may apply.

Reply STOP to an SMS to opt out of further SMS marketing communications.

Reply HELP for help.

We will not share your mobile information with third parties for their own promotional or marketing purposes.

11. Marketing Preferences

You may change your marketing preferences or withdraw your consent to marketing at any time.

You may:

  • use an unsubscribe link contained in an email;
  • reply STOP where available for SMS;
  • request that we stop contacting you through WhatsApp;
  • contact us directly and ask to change your marketing preferences.

Opting out of marketing does not prevent us from sending communications that are reasonably necessary in connection with an existing enquiry, booking, transaction or service.

12. Intellectual Property

Unless otherwise stated, the Aerial Ashes name, website content, text, graphics, branding, photographs, videos, processes and other materials are owned by or licensed to Aerial Ashes Ltd.

They may not be reproduced, commercially exploited or distributed without our permission except where permitted by law.

13. Website Use

You must not misuse our website, attempt unauthorised access, introduce malicious software, interfere with its operation or use it for unlawful purposes.

We may change, suspend or withdraw parts of our website without notice.

14. Third-Party Services

Our services may involve third-party providers, including payment processors, telecommunications providers, CRM systems, messaging providers, hosting providers, video platforms and other technology or operational suppliers.
